| Regional Board Conclusion: | This pollutant is being considered for placement on the CWA section 303(d) List under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status. The State Water Board’s Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California (the “ISWEBE Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use, which were adopted on August 7, 2018. Because the salinity level of this waterbody is equal to or less than 1 part per thousand 95 percent or more of the time, the E. coli bacteria objective applies. Therefore, this waterbody is being considered for placement on or removal from the CWA section 303(d) List under section 3.3 or 4.3 of the Listing Policy, as applicable, using the E. coli objective. Two lines of evidence are available in the administrative record to assess this pollutant for the REC-1 beneficial use. Four of the four samples exceed the 6-week E.coli Geomean objective. Zero of the three samples exceed the E.coli Statistical Threshold Value (STV) objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for this water segment-pollutant combination to remain delisted from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four of four samples exceed the E.coli Geomean Objective and zero of the three samples exceed the E.coli Statistical Threshold Value (STV) objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. In accordance with section 6.1.5.3 of the Listing Policy, data should be representative of the critical timing that the pollutant is expected to impact the waterbody. Indicator bacteria (total coliform, fecal coliform, E. coli, enterococci) populations may fluctuate substantially on a daily, seasonal, or yearly basis. Lacking constant inputs, they do not persist in the environment for a long period and effects are of relatively short duration. As a result, the historic levels of indicator bacteria in the waterbody may be a poor indicator of current risks to human health, particularly when more recent data are available to sufficiently assess the water quality standard. Additionally, water quality conditions in waterbodies may change as a result of management actions that have been implemented to address bacteria. Unrepresentative data may result in incorrectly placing or not placing a water body segment on the list, which could result in the unnecessary expenditure of public resources or failure to address a human health risk. Historic lines of evidence for data collected prior to 2010 were evaluated pursuant to these considerations and were not used to assess water quality standards attainment because they do not meet the temporal representation requirements of section 6.1.5.3 of the Listing Policy. These historical lines of evidence are: 2 LOEs for Total Coliform (82385, 82386), 2 LOEs for Fecal Coliform (82383, 82384), 2 LOEs for Enterococcus (82379, 82380), 3 LOEs for E.coli (82381, 26082, 82382) and will be retired. For E.coli data, Listing Policy sections 3.3 and 4.3 instructs to use the binomial distribution table in sections 3.2 and 4.2, as applicable. To use the binomial table that uses a four percent exceedance frequency, the data must be collected from coastal beaches or inland surface waters from April 1 through October 31 only, and where collected from inland waters from April 1 through October 31 only, bacterial measurements must be indicative of human fecal matter, and there is substantial human contact in the waterbody. From the 2016 Listing Cycle: This pollutant is being considered for removal from the CWA section 303(d) List based on a water quality objective change to E. coli and the lack of sufficient exceedances of E. coli under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. In 2012, the Regional Board revised its Basin Plan with new Pathogen Bacteria Indicator Objectives for REC-1(Resolution No. R8-2012-001, approved by USEPA in 2015). In general, the primary objective is <126 E. coli organisms per 100 mL as a geomean of at least 5 samples in a running 30-day period. Further, the Single Sample objective was only used because of the lack of representative 30-day, 5-sample Geomean values, as per the Region 8 Basin Plan (2016 update) on page 4-17, footnote 3. Nine (9) lines of evidence are available in the administrative record to assess this pollutant. Zero (0) of 0 samples exceed the E. coli Geomean Objective. Forty Nine (49) of 315 samples exceed the E. coli Single Sample Objective. In assessing the E. coli LOEs: LOE 26082 did not use the correct SSM E. coli wqo of 409 mpn/100mL as a Tier C water and therefore there should be 27 exceedances of 150 samples not 37 exceedances of 150 samples. LOE82381 did not use the correct SSM E. coli wqo of 409 mpn/100mL as a Tier C water and miscounted the number of samples and therefore there should be 22 exceedances of 165 samples not 42 exceedances of 164 samples. This results in a grouped total of 49 exceedances of 315 samples, which does not exceed Table 3.2 for a listing for Indicator Bacteria based on E. coli. Finally, LOE82382 misidentified 30-day, 4-sample geomeans as 30-day, 5-sample geomeans. 5-samples is the water quality objective specified in the R8 Basin Plan and for that data set, the minimum period for 5 samples in that data set is 50 days. From the 2010 Listing Cycle: USEPA Final Approval Decision Details: The November 12, 2010 USEPA partial approval letter and the October 11, 2011 final approval letter both from Alexis Strauss, USEPA Region 9, to Tom Howard, SWRCB, concluded the following: USEPA added Santa Ana River, Reach 2 to the list of water quality limited segments requiring a TMDL for indicator bacteria. This water body is designated as a Water Contact Recreation (REC1) water body either explicitly or implicitly as tributaries to other designated segments (RWQCB Santa Ana Region, 2008, Table 3-1, pp.3-23 - 3-35). The Santa Ana Basin Plan has the following water quality objective for fecal coliform to protect REC1 beneficial use: Fecal coliform: log mean less than 200 organisms/100 mL based on five or more samples/30 day period, and not more than 10% of the samples exceed 400 organisms/100 mL for any 30-day period. (RWQCB Santa Ana Region, 2008, pp.4-9). USEPA compared the E. coli data for subject water bodies to the Basin Plan's fecal coliform objective, as well as to USEPA's recommended E. coli criteria and the results were: 1. Thirty-seven of the 150 samples taken exceeded the USEPA E. coli criteria (235 organisms/100ml). 2. Twenty-seven of the 150 samples taken exceeded the Basin Plan objective for fecal coliform (400 organisms/100ml). For this water body segment, sufficient exceedances of the fecal coliform objective and the USEPA recommended criteria exist to merit listings per the 10% exceedance threshold for conventional pollutants expressed in Table 3.2 of the State Listing Policy. Note: All lines of evidence (LOEs) previously made by the Regional Boards have been revised where necessary in accordance with USEPA's final decision. |

| Regional Board Conclusion: | Benthic community effects are being considered for placement on the CWA section 303(d) List under section 3.9 of the Listing Policy. Under section 3.9, when data show benthic community degradation and there is at least one pollutant impairment that could impact benthic macroinvertebrates, the waterbody is placed on the 303(d) List for benthic community effects. Eight lines of evidence evaluating benthic macroinvertebrate bioassessment data are available in the administrative record to assess this indicator. Seven of eight benthic-macroinvertebrate samples exceed the California Stream Condition Index (CSCI) impairment threshold of 0.79. At least one line of evidence includes sufficient pollutant exceedances to indicate the waterbody is impaired for at least one pollutant. However, there is insufficient data and/or information to determine if at least one pollutant could be impacting benthic macroinvertebrates. Based on the readily available data and information, the evidence indicates that there is sufficient justification against placing Benthic Community Effects in this waterbody segment on the CWA section 303(d) List. Although there is insufficient data and/or information to make a beneficial use support determination, the exceedances of the benthic macroinvertebrate samples indicate beneficial uses may be potentially threatened. State Water Board staff evaluated the copper data using a default CTR translator to translate the data from total recoverable to dissolved for comparison to the California Toxics Rule (CTR) criteria for copper. This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant with the CTR chronic criteria. Twenty-nine of 57 samples exceed the CTR criteria. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Twenty-nine of 57 samples exceed the California Toxics Rule chronic criteria and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body-pollutant combination. Based on this reevaluation, State Water Board staff continued to recommend to place this water body on the 303(d) list for copper. At the August 4, 2010 State Water Board's follow-up Board meeting for approval of the 2010 Integrated Report, the State Water Board did not approve the State Water Board staff recommendation and instead recommended to not place this water body on the 303(d) list for copper. |
