Two lines of evidence are available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. Regional Board Conclusion: | Benthic community effects are being considered for placement on the CWA section 303(d) List under section 3.9 of the Listing Policy. Under section 3.9, when data show benthic community degradation and there is at least one pollutant impairment that could impact benthic macroinvertebrates, the waterbody is placed on the 303(d) List for benthic community effects. Eleven lines of evidence evaluating benthic macroinvertebrate bioassessment data are available in the administrative record to assess this indicator. Eleven of eleven benthic-macroinvertebrate samples exceed the California Stream Condition Index (CSCI) impairment threshold of 0.79. At least one line of evidence includes sufficient pollutant exceedances to indicate the waterbody is impaired for at least one pollutant. However, there is insufficient data and/or information to determine if at least one pollutant could be impacting benthic macroinvertebrates. Based on the readily available data and information, the evidence indicates that there is sufficient justification against placing Benthic Community Effects in this waterbody segment on the CWA section 303(d) List. Although there is insufficient data and/or information to make a beneficial use support determination, the exceedances of the benthic macroinvertebrate samples indicate beneficial uses may be potentially threatened. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Eleven of eleven benthic macroinvertebrate bioassessment samples had CSCI scores below 0.79. 4. At least one line of evidence includes sufficient pollutant exceedances to indicate the waterbody is impaired for at least one pollutant related to aquatic life; however, data and/or information are insufficient to determine if the pollutant(s) is impacting benthic macroinvertebrates. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. Data Used to Assess Water Quality: | One-tenth the organic carbon normalized LC50 values for sediment-bound pyrethroids were used as toxicity thresholds in a toxicity unit (TU) analysis. Samples containing at least 2 pyrethroids with concentrations above the reporting limit were assessed for additive toxicity. 4 of 4 sediment samples indicated a calculated TU > 1, suggesting that samples had pyrethroid pesticides at levels expected to exert additive, chronic toxicity.
