Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. This waterbody was placed on the 303(d) list based on data collected prior to year 2000. 4. There are not enough recent samples to justify removing this waterbody from the impaired waters list according to Table 4.1 of the Listing Policy. 5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy. Under section 4.3 a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant. Nine of ten samples exceed the geometric mean objective. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. The water segment shall remain on the impaired waters list as being addressed by a USEPA-approved TMDL. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Nine of ten samples exceeded the geometric mean objective for bacteria and these exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. The Napa River Pathogen TMDL was approved by USEPA in November 2006 5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded. |

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.5 of the Listing Policy. Under section 3.5 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess the pollutant. LOE 94601 is removed from this assessment as the LOE data are collected from a station located within the following waterbody: "Napa River, non-tidal." data from LOE 94601 data are reassessed for "Napa River, non-tidal." WILD beneficial use (prey fish objective): LOE 269166: 1 of 1 samples exceed the mercury objective and consist of 15 trophic level 3 and 4 fish. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Tissue samples were compared with the prey fish objective and 1 of 1 samples exceed WILD beneficial. The annual average sample consists of 15 individual fish. Insufficient information is available to determine beneficial use support for this waterbody-pollutant combination with the statistical power and confidence required by the Listing Policy. However, the fact that the sample is composed of 15 fish that independently accumulated enough mercury such that the average of all these fish exceeds the mercury objective indicates beneficial uses may be potentially threatened. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

All fish collected within the same calendar year with a reported length of 50-150 mm were averaged into a single sample, independent of species or trophic level, for comparison with the objective. This LOE consists of a total of 15 fish, which were aggregated into 1 annual averages, consisting of 1 fish species (3 composite(s) of Mississippi silverside each composed of 5 fish per composite). Napa River, tidal |

Pollutant: | Sedimentation/Siltation |
Final Listing Decision: | Delist from 303(d) list (TMDL required list) |
Last Listing Cycle's Final Listing Decision: | Delist from 303(d) list (TMDL required list)(2016) |
Revision Status | Original |
Reason for Delisting: | Delisting due to spatial change or other CalWQA administrative reason |
Impairment from Pollutant or Pollution: | Pollutant |
Regional Board Conclusion: | De-listing due to a mapping change. Napa River was split into a tidal and non-tidal portion. The impairment for sedimentation-siltation was for the non-tidal portion, and all of the data supporting the listing was for that portion.
The listing for sediment in Napa River originated from fine sediment impacts to spawning and rearing habitat as noted in the TMDL. The TMDL provides actions to reduce fine sediment input to the non-tidal portions of the main stem and all freshwater tributaries. When the Napa River was a single water body segment, the impairment and TMDL applied to entire main stem segment. Now that we have separated Napa River into tidal and non-tidal segments for the Integrated Repot purposes, we removed the listing for sediment from the tidal segment to be consistent with the impairment analyses and implementation actions required in the TMDLs. |
Regional Board Decision Recommendation: | After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.
This is due to a mapping change. The sedimentation/siltation impaired portion of Napa River is the non-tidal portion. |
