Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.
Four lines of evidence are available in the administrative record to assess mercury concentrations in fish fillets.

LOEs 21170, 47593, and 46508 are replaced with LOE 133323.
LOEs 664, 47594 and 47595 are replaced with LOE 133940.
132880, 133323, 133940, and 133943 are reassessments of the same data according to the mercury objectives.

WILD beneficial use: 2 of 3 trophic level four fish tissue samples exceed the mercury objective.

COMM beneficial use: 1 of 3 trophic level four fish tissue samples exceed the mercury objective. Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.
This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. Two of 3 trophic level four samples (based on annual averages) exceed the sportfish objective as applied to the WILD beneficial use in the mercury objectives and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. One of 3 trophic level four samples (based on annual averages) exceed the sportfish objective for the COMM beneficial use. An OEHHA Do Not Eat Health Advisory for Black Bass exists for Trinity Lake and the East Fork Trinity River. The health advisory and 1 exceedance (based only on Smallmouth Bass) results in adequate evidence of impairment of the waterbody for the COMM beneficial use according to Listing Policy section 3.4. A minimum of 3 annual averages based on composite fish tissue samples must meet the standard in order to indicate attainment of the standard.
3. This process is scientifically defensible and reproducible.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 grams/day is considered more protective of human health since recommendations are now to eat 1 meal a week of fish to obtain necessary Omega 3 nutrition. The fish consumption rate of 32 grams/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Samples were collected from 4 locations. Individual sample locations consisted of an area within a given waterbody from which fish tissue samples were collected. The number of sample locations per waterbody was based on the overall size of the waterbody (SWAMP, 2010). Each composite sample was from a different location in the Lake and therefore is considered its own sample. Three composites were generated: one from White Crappie (6 fish) and two from Smallmouth Bass (6 fish per composite). The results of the two composites for Smallmouth Bass, from fish collected on the same day, were averaged per USEPA 2001. The results of the third composite of White Crappie, were considered a second sample. This LOE re-assess data from LOE 21170 from the 2010 Integrated Report, which incorrectly evaluated each composite as its own sample. The evaluation guideline has also been updated in this LOE.

Data Used to Assess Water Quality: Five out of 12 samples exceeded the evaluation guideline. Filet composite and individual samples were collected. Species collected were brown trout, rainbow trout, chinook salmon, largemouth bass, smallmouth bass, and white catfish. Two individual samples of chinook salmon, 8 individual samples of smallmouth bass, and 1 composite of smallmouth bass exceeded the guideline (TSMP, 2002). Sample results for each species collected on the same date were averaged. This LOE re-assesses data from LOE 664 from the 2010 Integrated Report cycle to update the evaluation guideline and to average data for each species where fish were collected on the same day at the same location.

Data Used to Assess Water Quality: All 3 of 3 total mercury composite samples of fish from Trinity Lake exceed the evaluation guideline. Sample composite concentrations range from 0.45 mg/kg to 1.02 mg/kg. Sample composites were made from fish of each species of approximately the same size. For Trinity Lake, 3 sample composites were made as follows: 6 white catfish that range in fork length size from 362 mm to 412 mm, 6 small mouth bass from 400 mm to 439 mm; and 6 small mouth bass from 344 mm to 367 mm. Sample composites were analyzed for total mercury with the assumption that 100% of the total mercury value represents the methylmercury content of tissue. Data is summarized by the California Department of Water Resources (DWR 2001; DWR 2007).
