Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List. Five lines of evidence are available in the administrative record to assess the pollutant. LOE 92027 is replaced with LOE 307540. LOE 307540 is a reassessment of the same data following the statewide mercury objectives adopted in 2017. LOE 693 is replaced with LOE 307511. LOE 307511 is a reassessment of the same data following the statewide mercury objectives adopted in 2017. COMM beneficial use: Fish used in the COMM assessment are limited to lengths that are within Calif. Dept. of Fish and Wildlife legal size limits applicable to this waterbody. LOE 307511: 1 of 1 samples exceed the mercury objective and consist of 12 trophic level 4 fish (CDFW legal size limit). LOE 307540: 1 of 1 samples exceed the mercury objective and consist of 21 trophic level 4 fish. WILD beneficial use: LOE 307563: 1 of 1 samples exceed the mercury objective and consist of 9 trophic level 3 and 4 fish. LOE 307476: 1 of 1 samples exceed the mercury objective and consist of 21 trophic level 4 fish. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. CDFW legal size limit tissue samples were compared with the sport fish objective and 1 of 1 samples exceed for the WILD beneficial use and 1 of 1 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish that are annual averages and are aggregated from at least eight fish and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Tissue samples were compared with the prey fish objective and 1 of 1 samples exceed WILD beneficial use. The exceeding sample, which may contain a mix of trophic levels, is aggregated from at least eight fish and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. 5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met. |

Evaluation Guideline: | The OEHHA Fish Contaminant Goal for selenium in fish tissue is 7.4 ppm. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day. A background dietary consumption rate of 0.114 mg/day is applied for this micronutrient. (Klasing, S., and R. Brodberg, 2008) | ||||
