Reason for Delisting: Flaws in original listing
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

The State Water Board’s Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California (the “ISWEBE Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use, which were adopted on August 7, 2018. Because the salinity level of this waterbody is equal to or less than 1 part per thousand 95 percent or more of the time, the E. coli bacteria objective applies. Therefore, this waterbody is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy using the E. coli objective.

Two (2) lines of evidence of E.Coli data were evaluated for this waterbody and are based on recent E. coli data, collected since 2010, and compared to the newer E. coli bacteria water quality objective.

In accordance with section 6.1.5.3 of the Listing Policy, data should be representative of the critical timing that the pollutant is expected to impact the waterbody. Indicator bacteria (total coliform, fecal coliform, E. coli, enterococci) populations may fluctuate substantially on a daily, seasonal, or yearly basis. Lacking constant inputs, they do not persist in the environment for a long period and effects are of relatively short duration. As a result, the historic levels of indicator bacteria in the waterbody may be a poor indicator of current risks to human health, particularly when more recent data are available to sufficiently assess the water quality standard. Unrepresentative data may result in incorrectly placing or not placing a water body segment on the list, which could result in the unnecessary expenditure of public resources or failure to address a human health risk. The historic data was evaluated pursuant to these considerations and was not used to assess water quality standards attainment because it does not meet the temporal representation requirements of section 6.1.5.3 of the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.

2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.

3. Zero out of the 2 samples exceeded the E. Coli Geomean Objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 5 samples is needed to determine if a beneficial use is not supported using Table 3.2 of the Listing Policy.

4. Zero out of the 3 samples exceeded the E. Coli Statistical Threshold Value (STV) Objective and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 5 samples is needed to determine if a beneficial use is not supported using Table 3.2 of the Listing Policy.

5. A weight of evidence was presented in the last cycle indicating that the original 1998 listing was flawed. Therefore, the waterbody should not have been placed on the 303(d) list. As such, the most recent data collected to date do not support listing according to Table 3.2 of the Listing Policy because of insufficient information.

6. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

The language below is from a previous cycle:

The weight of evidence (see below) indicates that the original 1998 listing was for impairment of the MUN Beneficial Use and the bacteria-based water quality objectives for MUN were removed with the Santa Ana Regional Water Board REC Standards Basin Plan Amendment. Further, the most recent data, which on its own could not be used in this 2016 Integrated Report to justify a delisting action, simply provides further evidence that Lake Fulmor is attaining the REC-1 Beneficial Use.

Evidence used for Decision -

Lake Fulmor was added to the 303(d) List in 1998 based on a finding that the waterbody was impaired for pathogens. Subsequent listing cycles in 2002 and 2006 retained the listing. None of these three 303(d) lists indicated what beneficial use was impaired, only that the impairment was for pathogens. The 2010 303(d) List was the first list that included a Fact Sheet for Lake Fulmor (Decision #7225). This appears to be the first time that the impaired beneficial use was identified, i.e., Water Contact Recreation (REC‐1).

No Administrative Record appears to be available for the 1998 listing, but an Administrative Record has been established to support the 2002 and 2006 303(d) Listings. The publicly available Administrative Record includes one water quality report for Lake Fulmor (Reference #225): Santa Ana RWQCB. 1992. Water quality data‐Fulmer [sic] Lake. Riverside, CA: Santa Ana RWQCB. This report documents water quality results from a single day sampling event at three lake sites on August 19, 1992. The report concludes that the MUN total coliform objective was not being met, but makes no mention regarding compliance with the REC‐1 fecal coliform water quality objectives. At the time of the 1998 303(d) listing the MUN total coliform objective was 100 MPN/100 mL and the data clearly shows 3 of 3 exceedances of the MUN water quality objective. In fact, the report in the Administrative Record states: Due to the high levels of coliform present in the lake the beneficial use of MUN is definitely not being met (see Administrative Record reference #225).

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

Final Listing Decision: List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision

Expected TMDL Completion Date: 2037
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. Five of the 10 samples exceed the COLD dissolved oxygen objective. One of the 10 samples exceed the WARM dissolved oxygen objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Five of 10 samples exceed the COLD dissolved oxygen objective and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.
