Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under sections 4.2 and 4.3 of the Listing Policy. Under these sections a single line of evidence is necessary to assess listing status.

The State Water Board’s Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California (the “ISWEBE Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use, which were adopted on August 7, 2018. If the salinity level of a waterbody is equal to or less than 1 part per thousand 95 percent or more of the time, the E. coli bacteria objective applies; otherwise, the enterococci objective applies.

There are three monitoring stations included in the assessment for this waterbody. One station is located upstream form Hwy 1 (referred to as CNBCU or LTCU) and is likely freshwater, while the other two stations are located at the outlet to the Newport Coast ((referred to as CNBCC or LTC) and P3-OC5) with measured conductivity results exceeding the equivalent of one part per thousand salinity. Therefore, this waterbody is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy using the both the E. coli and Enterococci objectives until such time as the waterbody is resegmented into two distinct reaches and stations are assigned the appropriate freshwater or marine designation for assessment.

Although new E.coli geomean and STV data exist for this waterbody, the data were collected at station P3-OC5 (Los Trancos Creek at Crystal Cove State Park) where the conductivity data indicate that it should be assessed against the enterococci objectives because the salinity >1 ppt, > 5% of the time. These data were not assessed because of the incorrect indicator. No new enterococci data exist in CEDEN for this creek.

Pursuant to section 3.11 of the Listing Policy, additional data and information are available indicating that standards are not met (LOE #306268). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for keeping this water segment-pollutant combination on the CWA section 303(d) list. This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The following information indicates that the water quality standard is not being attained: Reassessment of data for Los Trancos shows the following: 470 of 525 geomeans exceed the 30 cfu/100ml enterococci geomean objective which exceeds the allowable frequency in Table 4.2 of the Listing Policy. The data were collected from March 30, 1999 to October 27, 2009 are are presented in Table 16 of the 2020 Newport Coast Bacteria Impairment Assessment Report.
3. This process is scientifically defensible and reproducible.
