| Regional Board Conclusion: | This pollutant is being considered for removal from the CWA section 303(d) List under section 4.5 and 4.11 of the Listing Policy. Under section 4.5 a single line of evidence is necessary to assess listing status. Under section 4.11 when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List. Two lines of evidence are available in the administrative record to assess the pollutant. WILD beneficial use: LOE 289988: 1 of 1 samples exceed the San Francisco Bay mercury objective (fish sized 3-5 cm). EST beneficial use: LOE 3708 is a placeholder LOE to support a listing decision prior to 2006. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. A TMDL for dissolved oxygen was approved by USEPA in December 2018. This TMDL for Suisun Marsh will also resolve the mercury impairments Suisun Marsh system. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Data assessed prior to 2006 that indicated water samples were impaired for EST beneficial use. New data do not indicate that mercury objectives are being met. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |

Under section 3.2 a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant. Of these lines of evidence, 6 are based on continuous monitoring data and 0 are based on grab sample data. Continuous temperature data were used as the primary source of evidence for this assessment. A rolling 7-Day Average of Daily Maximum (7DADM) was calculated for all available data and a 7DADM is evaluated as a single sample. In the absence of natural or historical temperature data, the samples were compared against USEPA Region 10 recommended temperature requirements for each appropriate salmonid life stage present in the waterbody segment (Listing Policy Section 6.1.5.9).
