Regional Board Conclusion: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2, 4.3 and 4.11 of the Listing Policy. Under section 4.3 of the Policy, a minimum of one line of evidence is needed to assess listing status. Because a statistically sufficient number of geomean samples were not available, attainment of the bacteria objective was determined based only on the STV per the situation-specific weight of evidence approach outlined in Sections 4.11 of the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 13 of 17 samples exceeded the statistical threshold value for E. coli and these exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. The Los Cerritos Channel and Estuary, Alamitos Bay, and Colorado Lagoon Indicator Bacteria TMDL was approved by USEPA 9/7/2022.
5. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

All samples analyzed against the acute and chronic criteria had available pH and temperature data which was used to calculate the criteria. The temperature ranged from 7.2 to 27.5 C and the pH ranged from 6.7 to 9.1. Water Quality Objective/Criterion: The Basin Plan states, "In order to protect aquatic life, ammonia concentrations in inland surface waters characteristic of freshwater shall not exceed the values calculated for the appropriate instream conditions shown in Tables 3-1 to 3-3." Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Four out of 7 samples exceeded the pH water quality objective and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.


State Board Review and Conclusion:
Los Angeles Regional Board staff provided State Water Board staff pH data that were mistakenly omitted from the staff report for consideration of adoption by Los Angeles Water Board. State Water Board staff re-evaluated the available data and the recommendation has been revised. Based on the result of the data re-evaluation, State Water Board staff recommend to List Los Cerritos Channel for pH. The revised recommendation is as follows:
