Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under sections 4.2 and 4.3 of the Listing Policy. Under these sections a single line of evidence is necessary to assess listing status.

The Water Quality Control Plan for Ocean Waters (“Ocean Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use: a fecal coliform water quality objective and an enterococci water quality objective. The Ocean Plan bacteria water quality objective for the SHEL beneficial use is expressed in total coliform. This waterbody is being considered for placement on or removal from the CWA section 303(d) List under section 3.3 or 4.3 of the Listing Policy, as applicable, using the fecal coliform, enterococci and total coliform objectives.

Sixteen lines of evidence area available in the administrative record to assess this pollutant for the REC-1 beneficial use.
297 of 1838 samples exceed the 6-week Enterococcus Geomean Objective.
152 of 491 samples exceed the Enterococcus STV objective.
11 of 1098 samples exceed the monthly Fecal Coliform Geomean Objective.
120 of 2415 samples exceed the Fecal Coliform Single Sample Maximum Objective.

However, at OSBO2 and OSBO3, 164 of 489 samples, and 77 of 463 samples, respectively exceed the 6-week Enterococcus Geomean objective and this exceeds the allowable frequency in Table 4.2 of the Listing Policy.

Statistical threshold value (STV) exceedances would typically only be considered if there were insufficient samples available to calculate the geometric mean, in conformity with the Inland Surface Waters and Enclosed Bays and Estuaries Plan, Bacteria Provisions. Nevertheless, 75% of all sampling stations (3 of 4) in Seal Beach failed to meet the STV objectives during the period considered for this listing cycle. This is ample evidence that there is a continuing input of fecal contamination that has not yet been identified and mitigated.

Eight lines of evidence are available in the administrative record to assess this pollutant for the SHEL beneficial use. 1474 of 2443 samples exceed the 90th-percentile objective for Total Coliform.
1229 of 2443 samples exceed the median objective for Total Coliform.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.
This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 297 of 1838 samples exceed the 6-week Enterococcus Geomean Objective, 11 of 1098 samples exceed the monthly Fecal Coliform Geomean Objective and 120 of 2415 samples exceed the Fecal Coliform Single Sample Maximum Objective for the protection of REC-1 beneficial uses and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. At two stations, OSBO2 and OSBO3, 164 of 489 samples, and 77 of 463 samples, respectively exceed the 6-week Enterococcus Geomean Objective and this exceeds the allowable frequency in Table 4.2 of the Listing Policy.
5. 75% of all sampling stations (3 of 4) in Seal Beach failed to meet the STV objectives during the period considered for this listing cycle. This is ample evidence that there is a continuing input of fecal contamination that has not yet been identified and mitigated.
6. 1474 of 2443 samples exceed the 90th-percentile objective for Total Coliform and 1229 of 2443 samples exceed the median objective for Total Coliform for the SHEL beneficial use and this does exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
7. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

While there is justification for placing this water segment-pollutant combination on the CWA section 303(d) List for impairment of the SHEL beneficial use, the Santa Ana Water Board considers this waterbody-pollutant combination lowest priority for TMDL development as the water quality objective for the SHEL beneficial use has been determined by the State Water Board to require updating. On December 3, 2019, the State Water Board adopted the 2019 Triennial Review of the Ocean Plan and identified as a high priority a project to consider amending the Ocean Plan to review and revise the existing shellfish harvesting total coliform objective. The State Water Board recognized that the current total coliform water quality objective may be unattainable, as exceedances of the standard were found to be common in reference-quality areas. Following the update of the water quality objective, this waterbody will be reassessed and reprioritized for TMDL development, if needed.

In accordance with section 6.1.5.3 of the Listing Policy, data should be representative of the critical timing that the pollutant is expected to impact the waterbody. Indicator bacteria (total coliform, fecal coliform, E. coli, enterococci) populations may fluctuate substantially on a daily, seasonal, or yearly basis. Lacking constant inputs, they do not persist in the environment for a long period and effects are of relatively short duration. As a result, the historic levels of indicator bacteria in the waterbody may be a poor indicator of current risks to human health, particularly when more recent data are available to sufficiently assess the water quality standard. Additionally, water quality conditions in waterbodies may change as a result of management actions that have been implemented to address bacteria. Unrepresentative data may result in incorrectly placing or not placing a water body segment on the list, which could result in the unnecessary expenditure of public resources or failure to address a human health risk. Historic lines of evidence for data collected prior to 2010 were evaluated pursuant to these considerations and were not used to assess water quality standards attainment because they do not meet the temporal representation requirements of section 6.1.5.3 of the Listing Policy.

The historic LOEs are: 13 LOEs for enterococcus (4434 8241 8247 82471 82419 82472 82473 8244 82469 82470 8237 82474 8250), 1 LOE for E.coli (82475), 11 LOEs for Fecal coliform (82476 8242 8238 8251 8245 82481 82482 82479 82480 8248 82478), 12 LOEs for Total Coliform ( 82486 8252 8246 8243 82485 82484 82495 82494 82493 82492 8249 8240) and will be retired.

For enterococci data, Listing Policy sections 3.3 and 4.3 instructs to use the binomial distribution table in sections 3.2 and 4.2, as applicable. To use the binomial table that uses a four percent exceedance frequency, the data must be collected from coastal beaches or inland surface waters from April 1 through October 31 only, and where collected from inland waters from April 1 through October 31 only, bacterial measurements must be indicative of human fecal matter, and there is substantial human contact in the waterbody.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Data Used to Assess Water Quality: Trash immediately distracts the eye at first glance and is densely located in and near the water body. Inspections of trash conditions, and cleanup efforts in the San Gabriel River Estuary were conducted on January 23, 2010. Numerous photos were taken and reviewed to assess trash conditions. All photos exhibit poor to very poor trash conditions within the estuary. The trash is too numerous to count, and the types of trash depicted in the photos include shopping carts, tires, toys, clothing, furniture, household items, bottles and cans.
