Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Eight (8) lines of evidence area available available in the administrative record to assess this pollutant for the REC-1 beneficial use. Zero (0) of 867 samples exceed the 6-week Enterococcus Geomean Objective. Seventeen (17) of 244 samples exceed the Enterococcus Statistical Threshold Value. Zero (0) of 290 samples exceed the monthly Fecal Coliform Geomean Objective. Twelve (12) of 1004 samples exceed the Fecal Coliform Single Sample Maximum Objective. Four (4) lines of evidence are available in the administrative record to assess this pollutant for the SHEL beneficial use. One-hundred seventy-six (176) of 1107 samples exceeded the 90th percentile objective for Total Coliform and Thirty-seven (37) of 1107 samples exceeded the median objective for Total Coliform for the SHEL beneficial use. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero (0) of the 867 samples exceed the Enterococcus Geomean Objective for the REC-1 beneficial use, Zero (0) of the 290 samples exceed the Fecal Coliform Geomean Objective for the REC-1 beneficial use, Thirty-seven (37) of the 1107 samples exceed the Total Coliform Median Objective for the SHEL beneficial use and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Twelve (12) of the 1004 samples exceed the Fecal Coliform Single Sample Maximum Objective for the REC-1 beneficial use, One-hundred seventy-six (176) of the 1107 samples exceed the Total Coliform 90th-percentile Objective for the SHEL beneficial use and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. The Water Quality Control Plan for Ocean Waters (“Ocean Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use: a fecal coliform water quality objective and an enterococci water quality objective. The Ocean Plan bacteria water quality objective for the SHEL beneficial use is expressed in total coliform. This waterbody is being considered for placement on or removal from the CWA section 303(d) List under section 3.3 or 4.3 of the Listing Policy, as applicable, using the fecal coliform, enterococci and total coliform objectives. For enterococci data, Listing Policy sections 3.3 and 4.3 instructs to use the binomial distribution table in sections 3.2 and 4.2, as applicable. To use the binomial table that uses a four percent exceedance frequency, the data must be collected from coastal beaches from April 1 through October 31 only.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:	For enterococci data, Listing Policy sections 3.3 and 4.3 instructs to use the binomial distribution table in sections 3.2 and 4.2, as applicable. To use the binomial table that uses a four percent exceedance frequency, the data must be collected from coastal beaches from April 1 through October 31 only.

Regional Board Conclusion:	There was no new data considered in the 2014 Listing Cycle, this previously made decision will carryover. The following description applies to an earlier Listing Cycle. This pollutant is being considered for placement on the section 303(d) list under section 3.5 of the Listing Policy. One line of evidence is available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Three of the 21 samples exceeded the OEHHA Screening Value and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

All 21 samples were filet composites representing the following species: Barred Surfperch, Black Surfperch, California Corbina, Diamond Turbot, Shiner Surfperch, Spotted Scorpionfish, Spotted turbot, Waleye Surfperch, White Croaker, and Yellowfin Croaker. Walleye Surfperch from Balboa Pier and Newport Beach exceeded the guideline. Shiner Surfperch from Newport Beach and Newport Jetty also exceeded guideline (TSMP, 2002). There is a fish advisory for DDT and PCBs.
