Regional Board Conclusion:	Benthic community effects are being considered for placement on the CWA section 303(d) List under section 3.9 of the Listing Policy. Under section 3.9, when data show benthic community degradation and there is at least one pollutant impairment that could impact benthic macroinvertebrates, the waterbody is placed on the 303(d) List for benthic community effects. Three lines of evidence evaluating benthic macroinvertebrate bioassessment data are available in the administrative record to assess this indicator. Three of three benthic-macroinvertebrate samples exceed the California Stream Condition Index (CSCI) impairment threshold of 0.79. At least one line of evidence includes sufficient pollutant exceedances to indicate the waterbody is impaired for at least one pollutant. However, there is insufficient data and/or information to determine if at least one pollutant could be impacting benthic macroinvertebrates. Based on the readily available data and information, the evidence indicates that there is sufficient justification against placing Benthic Community Effects in this waterbody segment on the CWA section 303(d) List. Although there is insufficient data and/or information to make a beneficial use support determination, the exceedances of the benthic macroinvertebrate samples indicate beneficial uses may be potentially threatened. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Regional Board Conclusion:	During 2024 cycle, the 1988 National Recommended Water Quality Criteria used to assess aluminum data was replaced with U.S. EPA’s 2018 Final Recommended Aquatic Life Criteria for Aluminum in Freshwater. This pollutant is being considered for placement on the CWA section 303(d) List under sections 3.1 and 3.11 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant. Two of two samples exceed the evaluation guideline for the aquatic life beneficial use. These sampling locations did not have site specific pH data associated with them to complete the calculation of the aluminum criteria. When pH data were not available, the median pH value for the ecoregion was used as a comparable surrogate. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of two samples (total fraction) exceed the evaluation guideline for the aquatic life beneficial use, and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. However, as pH data were not available, and the median pH value for the ecoregion was used as a comparable surrogate, section 3.11 will be used as the basis for listing. 4. Pursuant to section 3.11 of the Listing Policy, inclusion of pH data (median pH value for the ecoregion) in the equation indicates that standards are not met.
