Regional Board Conclusion: This waterbody was split as part of the 2024 cycle Delta Remapping Project. Decisions were reassessed based on the new spatial representation, which resulted in a delisting.

This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List.

One line of evidence was used in this assessment. Zero of 23 samples collected after approval of a TMDL exceed the objective for WARM.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. Delta Diazinon and Chlorpyrifos Project was approved by USEPA in October of 2007.
3. The following information indicates that the water quality standard is attained: Zero of 23 samples collected after approval of a TMDL exceed the objective for WARM. This is sufficient to determine beneficial use support according to the Listing Policy.
3. This process is scientifically defensible and reproducible.

The Stockton Urban Waterbodies Pathogen TMDL has been approved by the Central Valley Water Board in 2008 and approved by USEPA on 13 may 2008.

This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

The State Water Board’s Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California (the “ISWEBE Plan”) contains two bacteria water quality objectives applicable to the REC-1 beneficial use, which were adopted on August 7, 2018. Because the salinity level of this waterbody is equal to or less than 1 part per thousand 95 percent or more of the time, the E. coli bacteria objective applies Therefore, this waterbody is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy using the E. coli objective.

A total of three lines of evidence of E. coli data were evaluated for this waterbody. Of these lines of evidence, all three are based on data collected prior to 2010. Two lines of evidence are based on historic E. coli collected prior to 2010 and one is a placeholder for pathogens based on pre-2006 data.

In accordance with section 6.1.5.3 of the Listing Policy, data should be representative of the critical timing that the pollutant is expected to impact the waterbody. Indicator bacteria (total coliform, fecal coliform, E. coli, enterococci) populations may fluctuate substantially on a daily, seasonal, or yearly basis. Lacking constant inputs, they do not persist in the environment for a long period and effects are of relatively short duration. As a result, the historic levels of indicator bacteria in the waterbody may be a poor indicator of current risks to human health, particularly when more recent data are available to sufficiently assess the water quality standard. Unrepresentative data may result in incorrectly placing or not placing a water body segment on the list, which could result in the unnecessary expenditure of public resources or missing a human health problem. The three historic lines of evidence were evaluated pursuant to these considerations and was not used to assess water quality standards attainment because they do not meet the temporal representation requirements of section 6.1.5.3 of the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this waterbody from the list.

The data used satisfy the data quality requirements (section 6.1.4) and data quantity requirements (section 6.1.5) of the Listing Policy.

Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Data Used to Assess Water Quality: DeltaKeeper submitted bacteria data for water samples collected from two locations on the lower Calaveras River (Jennings, 2001). One sampling location is near the mouth of the river and the other is approximately four miles upstream. A total of 26 samples collected at the upstream location over during 10 months in 2000-2001, and a total of 11 samples collected at the downstream location during seven months in 2000, were analyzed. Geometric means of the bacteria counts have been calculated using the data submitted by DeltaKeeper. The geometric mean for E. coli is 322 MPN per 100 ml for samples collected at the upstream location (exceeding the USEPA criterion of 126 MPN per 100 ml). The geometric mean for E. coli for samples collected at the downstream location is 76 MPN per 100 ml. One (collected on 24 May 2000) of eleven water samples collected from the downstream site exceeded the USEPA single sample criterion of 235 MPN per 100 ml. Twenty-four water samples collected from the upstream site (at UOP footbridge) yielded 22 daily average MPN E. coli concentrations. Ten (collected on 28 August 2000; 11 October 2000; 30 October 2000; 8, 11, and 24 January 2001; 10 and 11 February 2001; and 5 and 26 March 2001 ) of the 22 water samples collected from the upstream site exceeded the USEPA single sample criterion of 235 MPN per 100 ml.

Evaluation Guideline: The California Department of Health Services (CDHS) has adopted regulations for recreational waters and beaches for single samples of total coliform bacteria of 10,000 Most Probable Number (MPN) per 100 milliliters and of 1,000 MPN per 100 ml for 30-day log mean of sample levels (Title 17 California Code of Regulation section 7958). CDHS has also published draft guidelines that include limits for single samples of E. coli of 235 MPN per 100 milliliters (CDHS, July 2000 http://www.dhs.ca.gov/ps/ddwem/beaches/freshwater.htm). USEPA guidelines for bacteria contained in Ambient Water Quality Criteria for Bacteria (USEPA, 1986a) state ¿Based on a statistically sufficient number of samples (generally not less than 5 samples equally spaced over a 30-day period), the geometric mean of the indicated bacterial densities should not exceed one or the other of the following: E. coli 126 MPN per 100 ml; or Enterococci 33 MPN per 100 ml.¿ A methodology for determining exceedances based on single samples is also included in the standards.

Spatial Representation: The original listing info in the Central Valley Water Board's 2002 303(d) list report indicated that the impaired portion of the lower 5 miles of the Calaveras River, within the Stockton urban area, have similar land use patterns and were recommended for listing as impaired due to pathogen contamination. Water samples were collected from two loations - near the mouth of the Calaveras River (Calaveras River at UOP footbridge), and approximately 4 miles upstream (Calaveras River at Deltakeeper Dock).
Temporal Representation: Twenty-four water samples were collected at the upstream location (at UOP footbridge) on 7, 14, 22, and 28 August 2000; 20 September 2000; 4, 11, 19, and 30 October 2000; 11, 21, and 28 November 2001; 6 December 2000, 8, 11, and 24 January 2001; 10 and 11 February 2001; and 5, 14, 20 and 26 March 2001. Regional Board Conclusion: This waterbody was split as part of the 2024 cycle Delta Remapping Project. Decisions were reassessed based on the new spatial representation.

This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant for Commercial or recreational collection of fish, shellfish, or organisms (COMM). Nine of the 12 samples exceed the criterion for COMM.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Nine of the 12 samples exceed the criterion for COMM and these exceed the allowable frequency listed in Table 4.1 of the Listing Policy.

This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess this pollutant.

Pursuant to section 6.1.5.9 of the Listing Policy, this assessment utilized the upper limit of the optimal temperature range for rainbow trout for growth and completion of most life stages to interpret the narrative water quality objective for temperature. 37 of 95 samples exceeded the evaluation guideline.

However, the available data are insufficient to satisfy the Listing Policy requirements for spatial and temporal representation (sections 6.1.5.2 and 6.1.5.3). The surface water grab samples collected did not provide sufficient temporal and spatial representation to determine if temperature conditions experienced by aquatic life were within the optimal temperature range throughout the entire water column or the length of time temperature conditions may have exceeded the optimal temperature range.

Available information for this waterbody-pollutant combination is insufficient to determine whether the aquatic beneficial use is supported. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available for this Integrated Report cycle indicating that standards are not met.

However, the exceedances of the evaluation guideline indicate that beneficial uses may be threatened. This decision will be reevaluated in the next Integrated Report cycle as more data and information become available. Additional data and information may include information demonstrating that sample location(s) are representative of conditions throughout the waterbody, data from additional sampling locations, continuous monitoring data collected in the waterbody, waterbody-specific information on sensitive resident species, their life stage time frames, and the appropriate temperature thresholds necessary to support each life stage.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list. Regional Board Conclusion: This waterbody was split as part of the 2024 cycle Delta Remapping Project. Decisions were reassessed based on the new spatial representation.

This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Six lines of evidence are available in the administrative record to assess this pollutant. Four of the 97 samples each exceed the objectives for COLD, REC-1, and REC-2.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Four of the 97 samples each exceed the objectives for COLD, REC-1, and REC-2 and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.
