Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Tissue samples were compared with the sport fish objective and 2 of 2 samples exceed for WILD beneficial use for CDFW legal limit fish and 3 of 3 samples exceed for the COMM beneficial use. The samples consist of trophic level 4 fish and are from a minimum of 2 annual averages and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

This LOE contains data only for trophic level 4 fish. The concentration of Mercury in fish collected within the same calendar year, for the same trophic level were averaged into a single sample for comparison with the objective. A total of 2 composites of Largemouth Bass were fish were aggregated into 1 annual averages, that exceeded the objecctive. The target minimum size for largemouth bass was a minimum of 12 inches. This LOE does not contain data from fish whos average length was outside of the legal size limits as described by the California Department of Fish and Wildlife Fishing Regulations.

The JC Boyle dam (in Oregon), Iron Gate dam, Copco 1 dam, and Copco dam were removed from the Klamath River in 2024. Section 6.1.5.3 of the Listing Policy states that "If the implementation of a management practice(s) has resulted in a change in the water body segment, only recently collected data [since the implementation of the management measure(s)] should be considered." Because dam removal has significantly changed the Klamath River hydrology, data for Iron Gate reservoir, Copco 1 reservoir, Copco 2 reservoir, and the mainstem Klamath River will not be assessed for the 2026 Integrated Report. This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.1 of the Listing Policy. Under section 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not delist).

There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (4) The Klamath River TMDL has been approved by the North Coast Regional Water Quality Control Board in March 2010 and approved by USEPA on December 28, 2010. Sample concentrations range from 0.00 to 473.39 ng/g. Nineteen of the tissue samples were collected from perch fillet, and 3 were collected from perch liver. Fish samples were collected by the California Department of Fish and Game (CDFG) and analyzed for microcystin by the CDFG Fish and Wildlife Water Pollution Control Laboratory in Rancho Cordova, CA. Data are summarized by Kann (2008). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. Data Used to Assess Water Quality: Water Board staff assessed SWAMP data for Copco Lake to determine beneficial use support and results are as follows: 0 of 1 samples exceed the criterion for PCB, Total. One composite (5 fish per composite) was generated from one species: largemouth bass. Details of the compositing protocol can be found in the March 2009 report entitled: "Contaminants in Fish from California Lakes and Reservoirs: Technical Report on Year One of a Two-Year Screening Study" (SWAMP, 2009). Total PCB was assessed for as follows: PCB aroclors and congeners were summed separately and the sum that yielded the highest value was used for the assessment.

This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a minimum of one line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of one sample exceeds the evaluation guideline used to interpret the narrative toxicity objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
