SWRCB water rights decision 1631 establishes conditions to control lake level and salt concentrations. Salt concentrations are not solely due to natural causes. Fifty years of water diversions caused a 45 foot drop in lake level, which caused increases in salt concentrations above those caused by natural sources. SWRCB Decision 1631 established a restored lake level of 6391 feet to reduce impacts from approximately fifty years of water diversions from Mono Lake inflow. Attainment of this lake level is expected to result in attainment of water quality standards (SWRCB, 2003).

Regional Board Conclusion: This decision was created to clarify the historical assessment for salinity/TDS/chlorides contained in Decision ID 80208. This new decision does not represent a change in assessment.

Mono Lake was considered for placement on the section 303(d) list for salinity/total dissolved solids/chlorides during the 1998 California Integrated Report. Mono Lake was found to be not attaining water quality standards during the 1998 cycle and placed on the 303(d) list. For the 2002 California Integrated Report, the Water Boards created an Enforceable Programs List for waterbodies where the “water quality standards are not met but the problem can be addressed now by another enforceable program.” The water quality limited segments included on the Enforceable Programs List were submitted to USEPA but were not included on the 303(d) list. The Mono Lake assessment for salinity/TDS/chlorides was part of the Enforceable Programs List in 2002 because the impairment was determined to be addressed by the state’s water rights order Decision 1631. In 2004, the State Water Board adopted the Listing Policy. In accordance with section 2.2 of the Listing Policy, water quality limited segments being addressed by a TMDL or by an existing regulatory program that “is reasonably expected to result in the attainment of the water quality standard within a reasonable, specified time frame” are to be included on the 303(d) list. To conform with section 2.2 of the Listing Policy, the Mono Lake assessment for salinity/TDS/chlorides was administratively moved from the outdated Enforcement Programs List to the 303(d) list during the 2006 Integrated Report.

No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged.

One line of evidence is available in the administrative record to assess this pollutant. LOE 358087 replaces LOE 736 by clarifying the historical details presented in LOE 736. This new LOE does not represent a change in assessment. A remedial program other than a TMDL has been developed, approved, and is being implemented. This program is expected to result in attainment of the standard.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
