PUBLIC NOTICE OF TEMPORARY URGENCY CHANGE OF PLACE OF USE UNDER PERMITS 16478, 16479, 16481 AND 16482 (APPLICATIONS 5630, 14443, 14445A AND 17512)—DIVERSION OR REDIVERSION OF WATER FROM THE
CALIFORNIA AQUEDUCT AT HARVEY O. BANKS PUMPING PLANT IN
SAN JOAQUIN COUNTY
On July 31, 1998, the California Department of Water Resources (DWR) filed a petition requesting a Temporary Urgency Change to add Tracy Golf and Country Club (Club) as an authorized place of use. DWR proposes to divert or redivert water at Harvey O. Banks
Pumping Plant for Club delivery at milepost 22.16 of the California Aqueduct. The water will be delivered to the Club from August 5, 1998 through January 15, 1999. Due to the urgent nature of DWR’s request and in accordance with Water Code section 1435 et seq, the State Water Resources Control Board (SWRCB) has issued a conditional Temporary Change Order to DWR. A copy of the Order adding the Club as an authorized place of use for the subject applications is enclosed for your review.
In accordance with section 1428 of the Water Code, the SWRCB is still required to provide public notice of DWR’s request to change the place of use. Therefore, the enclosed documents constitute your notification of the proposed change for the subject applications. Any interested person may file objections to the temporary diversion and use with the SWRCB concerning the DWR’s petition for the temporary urgency change. The materials must address the issues that the SWRCB evaluated, as set forth in the Order.
Materials filed in response to this notice must be submitted in writing by 4:00 p.m. on
August 28, 1998 at the addresses listed below. Due to the brief noticing period, interested parties are encouraged to file objections by FAX or to notify the following contact persons by telephone of any materials that will be submitted. However, an original copy of all materials must be received for the SWRCB to consider your concerns.
