TEMPORARY TRANSFER OF WATER UNDER

CALIFORNIA DEPARTMENT OF WATER RESOURCES\'

filed a letter informing the State Water Resources Control Board (SWRCB) of a proposed change regarding 20,000 acre-feet of a previously approved 100,000 acre-foot water transfer. The previously approved transfer involves a temporary change in place of use of 100,000 acre-feet of State Water Project water under Department of Water Resources’ (DWR) Permit 16482 (Application 17512) as authorized by SWRCB order of July 10, 1998. The temporary change was approved pursuant to SWRCB Order (copy enclosed) of December 7, 1998.

DESCRIPTION OF THE TRANSFER:

The original 100,000 acre-foot transfer program included a delivery of 20,000 acre-feet of Kern County Water Agency (KCWA) 1998 entitlement water to Westlands Water District (WWD) for use by Harris Ranch, a WWD landowner. Due to lower than anticipated water demands Harris Ranch delayed the delivery.

State Water Project (SWP) water stored in San Luis Reservoir is held for use in the service areas of Kern County Water Agency (KCWA) and Tulare Lake Basin Water Storage District (TLBWSD). The December 4, 1998 letter from DWR proposes that the 20,000 acre-feet of water for Harris Ranch be delivered to another SWP contractor, Tulare Lake Basin Water Storage District (TLBWSD), as an interim measure until Harris Ranch is prepared to receive the water. Harris Ranch recently concluded an agreement under which TLBWSD will take delivery of the 20,000 acre-feet of water by December 31, 1998. Completion of the transfer of the 20,000 acre-feet of water to WWD for Harris Ranch would be completed during the period March 1, 1999 through July 15, 1999. The interim exchange does not change the total quantity of SWP water exchanged.

 

 

 

 

APPLICABLE STATUTORY PROVISIONS

Pursuant to Water Code sections 1725 et seq., the SWRCB is authorized to approve temporary changes involving the transfer or exchange of water or water rights after completing an evaluation sufficient to determine that the proposed temporary change(s):

1. Would not increase the amount of water the permittee or licensee is entitled to use;

2. Involves only water that would otherwise have been consumptively used or stored by permittee or licensee;

3. Would not injure any other legal user of the water; and

4. Would not unreasonably affect fish, wildlife, or other instream beneficial uses.

By order dated December 7, 1998, the SWRCB approved a change in the previously approved water transfer. The order approving the change in the transfer becomes effective five days from the date of approval. Any person may file comments, objections and/or recommendations concerning DWR\'s petition for the temporary change in the previously approved water transfer. The materials must address the issues that the SWRCB must evaluate, as set forth above.

Materials filed in response to this notice must be submitted in writing by 4:00 p.m. on December 18, 1998 at the addresses listed below. Due to the brief noticing period, interested parties are encouraged to file any comments, etc., by FAX or to notify the following contact persons by telephone of any materials that will be submitted. However, an original copy of all materials must be received for the SWRCB to consider your concerns.
