Administrative Civil Liability - Eagle Ridge

Administrative Civil Liability Complaint No. R6V-2008-0001, Eagle Ridge at Arrowhead Development Project to be reissued for a larger amount of liability.

On February 5, 2008, the Regional Board issued Administrative Civil Liability Complaint (Complaint) No. R6V-2008-0001 recommending a $78,000 assessment of civil liability to Eagle Ridge at Arrowhead, LP and Simmons Construction, Inc. The Complaint alleged that these parties violated the Water Board’s Cleanup and Abatement Order No. R6V-2007-0037 by failing to adequately stabilize their project site, and failing to submit complete technical reports.

On March 5, 2008 the Water Board’s Assistant Executive Officer, who is the head of the Prosecution Team, rescinded the February 5th Complaint and announced his intent to issue a new Complaint that addresses additional violations and assesses an increased amount of civil liability. The hearing on the February 5, 2008 Complaint was scheduled for April 9-10, 2008, but is now cancelled. Following the issuance of the new Complaint, the Regional Board’s Advisory Team will send out a new Notice of Public Hearing that will establish a schedule for submitting relevant information in preparation for a public hearing on the new Complaint.
