San Diego Region - Tentative Orders

  • Notice of Written Comment Period and Hearing for Tentative Order No. R9-2025-0137. On August 1, 2025, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) released Tentative Order No. R9-2025-0137, Settlement Agreement and Stipulation for Entry of Administrative Liability in the Matter of Moulton Niguel Water District, January 2025 Sanitary Sewer System Spill (Tentative Order) for public review and comment. The Tentative Order is a stipulated administrative civil liability Order to settle liability associated with a sanitary sewer system spill that occurred from the Moulton Niguel Water District’s sanitary sewer system on January 10, 2025. The spill resulted in a discharge of 464,700 gallons of untreated sewage into Sulphur Creek, Aliso Creek, and Aliso Beach. To resolve the violation described in the Tentative Order without formal administrative proceedings, the San Diego Water Board’s Prosecution Team and Moulton Niguel Water District (Parties) reached a settlement and agreed to the imposition of an administrative civil liability in the amount of $553,000.   • Notice of Written Comment Period for Settlement Offer No. R9-2025-0102. On June 3, 2025, the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) issued Settlement Offer No. R9-2025-0102 to the San Diego County Sanitation District (District) for the January 22, 2024, sanitary sewer spill to Sweetwater Reservoir in violation of the federal Clean Water Act, California Porter-Cologne Water Quality Control Act, San Diego Water Board Basin Plan and state and regional waste discharge requirements. On July 2, 2025, the District accepted Settlement Offer No. R9-2025-0102 and waived its right to a hearing.
