The Regional Board requests that all lengthy comments be submitted in writing in advance of the meeting date. To ensure that the Regional Board has the opportunity to fully study and consider written material, comments should be received in the Regional Board's office no later than 5:00 P.M. on Wednesday, November 29, 2006, and should indicate the agenda item to which it is applicable. If the submitted written material is more than 5 pages or contains foldouts, color graphics, maps, etc., 20 copies must be submitted for distribution to the Regional Board members and staff. Written material submitted after 5:00 P.M. on Wednesday, December 6, 2006 will not be provided to the Regional Board members and will not be considered by the Regional Board.

PLEASE NOTE THAT SOME ITEMS ON THE AGENDA MAY HAVE BEEN PREVIOUSLY NOTICED WITH EARLIER DEADLINES FOR SUBMITTING WRITTEN COMMENTS. IN THOSE CASES THE EARLIER DEADLINES APPLY.

Comments on agenda items will be accepted by email subject to the same conditions set forth for other written submissions as long as the total submittal (including attachments) does not exceed five printed pages in length. Email must be submitted to: rb9agenda@waterboards.ca.gov to insure consideration by the Regional Board. Type the word "Agenda" in the subject line.

Pursuant to Title 23, California Code of Regulations, Section 648.4, the Regional Board may refuse to admit written testimony into evidence if it is not submitted to the Regional Board in a timely manner, unless the proponent can demonstrate why he or she was unable to submit the material on time or that compliance with the deadline would create an unreasonable hardship.

NOTE C, attached to this Notice, contains a description of the hearing procedures that will be followed by the Regional Board. Hearings before the Regional Board are normally conducted using procedures that do not include cross-examination. Parties requesting use of more formal procedures must do so in accord with the directions in NOTE C. Any such request, together with supporting material, must be received in the Regional Board's office no later than 5:00 P.M. on Wednesday, November 29, 2006.

The Regional Board will consider adopting a resolution (tentative Resolution No. R9-2006-0129) consisting of:

A. Approval of Glenwood Development Co.'s payment of $15,000 to the State Board's Cleanup and Abatement Account in settlement of all outstanding liability associated with the alleged violation of CAO Directive No. 3; and

A. Proposed UST Closure - Site 14131, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Groundwater Sampling Report and Request for Closure, UST Site 14131, Marine Corps Base Camp Pendleton, California" prepared by SES-TECH dated November 1, 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former underground storage tank (UST). Corrective action included the excavation and proper disposal of contaminated soil. The following groundwater samples indicated the residual concentrations of hydrocarbons do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files and CAP are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of completed corrective action as required by California Code of Regulations (CCR), Title 23, Division 3, Chapter 16, Article 11, Section 2728(a). B. Proposed UST Closure - Site 210620, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Groundwater Sampling Report and Request for Closure UST Site 210620 Marine Corps Base Camp Pendleton, California" prepared by SES-TECH dated November 7, 2005. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former underground storage tank (UST). The site is located west of Interstate 5 and the ground-water table is approximately 50 feet below grade at the site. Since the removal of the leaking USTs in 1997, various activities including site assessment, remedial action by soil vapor extraction, and ground-water monitoring have been conducted in order to mitigate the MtBE contaminated soil and ground water. The latest ground-water monitoring results indicate that the maximum concentration of MtBE remaining at the site is 220 µg/L as detected in the monitoring well approximately 360 feet south of the former USTs. Based on the existing information, the residual concentrations of MtBE do not pose a threat to human health or the environment, and the unauthorized release case may be closed. C. Proposed UST Closure - Site 53670-1, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Environmental Site Assessment Report Underground Storage Tank (UST) Site 53670-1 Marine Corps Base Camp Pendleton, San Diego County, California" prepared by Brown and Caldwell dated September 1999. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. Site assessment was conducted in March 1999, and the results indicate that soil contamination remaining at the site is approximately 25 yd3, with the maximum concentration of total recoverable petroleum hydrocarbon (TRPH) of 1,684 mg/kg detected at 2.5 feet below grade. No evidence of ground-water contamination was observed. Based on the existing information, the residual concentrations of fuel constituents do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. D. Proposed UST Closure - Site 52710, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Report on Additional Site Investigation and Request for Closure, UST Site 52710 Marine Corps Base Camp Pendleton, San Diego County, California" prepared by SES-TECH dated September 11, 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. Site assessment was performed in 2000 and 2006, respectively, to investigate the lateral and vertical extents of soil and ground-water contamination and no contamination was found remaining at the Site. Therefore, the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of the proposed actions pursuant to the State and Regional Boards' Public Participation guidance document. E. Proposed UST Remedy - Site 1313, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Corrective Action Plan" (CAP) for underground storage tank (UST) Site 1313, Marine Corps Base Camp Pendleton, California. The report, prepared by Battelle and dated September 20, 2006, provides alternative remedies for petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former USTs. In the CAP, the consultant recommends source area excavation and application of Oxygen Release Compound (ORC™) followed by additional well installation for monitoring natural attenuation of the plume. The case files and CAP are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of the proposed activities contained in a CAP as required by California Code of Regulations (CCR), Title 23, Division 3, Chapter 16, Article 11, Section 2728(a). F. Proposed UST Closure - Site 22151, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Corrective Action Plan for Site 22151 (Includes: Documentation of Interim Remedial Action Activities), Marine Corps Base Camp Pendleton" prepared by Battelle dated March 28, 2001. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former underground storage tank (UST). Groundwater conditions have since been continually monitored at site 22151 in association with a release at nearby gas stations. Analysis of sampling data shows that residual soil contamination underneath site 22151 was not a threat to groundwater. The case files are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of the completed corrective action per requirements of Title 23 CCR Chapter 16, Article 11, Section 2728(a). G. UST Closure - Tank 7928, MCAS Miramar
The Site Mitigation & Cleanup Unit has reviewed the "Final Remediation Report for Piping Repair at Tank 7928 Marine Corps Air Station Miramar, San Diego County, California" prepared by Westin Solutions dated May 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the UST piping system. Site assessment was conducted in June 2005 and a removal action in March 2006. Approximately 140 cubic yards of petroleum impacted soil was removed. No evidence of ground-water contamination was observed. Based on the existing information, the residual concentrations of fuel constituents do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of the proposed actions pursuant to the State and Regional Boards' Public Participation guidance document. H. Proposed UST Closure - Fuel Area B, MCAS Miramar
The Site Mitigation & Cleanup Unit has reviewed the "Final Remediation Report for Fuel Area B Marine Corps Air Station Miramar, San Diego County, California" prepared by Westin Solutions dated May 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the UST piping system. Site assessment and a removal action were conducted between October 2003 and April 2004. Approximately 469 tons of petroleum impacted soil was removed. No evidence of ground-water contamination was observed. Based on the existing information, the residual concentrations of fuel constituents do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. This public notice fulfills the Regional Board's obligation to inform the public of the proposed actions pursuant to the State and Regional Boards' Public Participation guidance document. I. Proposed UST Closure - Tank 1220, SW Div. Headquarters Bldg. 127 Naval Station SD
The Site Mitigation & Cleanup Unit has reviewed the "Draft Site Characterization Report - Tank 1220, San Diego County, California" prepared by US Navy NAVFAC Engineering dated April 2005. In the report, the Navy recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. A removal action was conducted in 1992. Approximately 240 cubic yards of petroleum impacted soil were removed. Less than 30 cubic yards of petroleum impacted soil remains in situ at concentrations greater than 46 mg/kg. No evidence of ground-water contamination was observed. Based on the existing information, the residual concentrations of fuel constituents do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. J. Proposed UST Closure - Ultramar Service Station #3743, 4405 Home Avenue, SD
The Tank Site Mitigation & Cleanup Unit has reviewed the "Site Assessment and Closure Request Report" (August 2006) and the "Additional Information Request" (October 2006) for Underground Storage Tank (UST) Site Ultramar Service Station #3743, prepared by Kleinfelder. The property is owned by Joseph and Daniel Yoder, and is operated by Valero. In the closure reports, the consultant recommends no further action at the site. Site assessment was conducted in 1993, 1994, 2004. Subsurface pollution was remediated by removal of soil wastes containing petroleum constituents. However, approximately 13,000 cubic yards of soil with a maximum concentration of Total Petroleum Hydrocarbon of 8,900 mg/kg remains at the Site. No groundwater was encountered in soil borings drilled to depths of to 56 feet below ground surface, and therefore, no evidence of groundwater pollution was found. Based on the existing information, the residual concentrations of fuel constituents do not pose a threat to human health or the environment, and the unauthorized release case may be closed. The case files are available for public review by submitting a file review request to the Regional Board office. K. Proposed UST Closure - Site 51811, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Environmental Site Assessment Report Underground Storage Tank (UST) Site 51811 Marine Corps Base Camp Pendleton California" prepared by Parsons dated August 2000. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. Site assessment was conducted in March through July 2000, and the results indicate that the majority of soil contamination is limited to approximately 400 cubic yards at depths of 9.0 to 22.5 feet. Maximum total recoverable petroleum hydrocarbon concentrations of 2,600 mg/kg and 11 mg/L respectively, were found at 20 feet below grade in soil and approximately 24 feet below grade in ground water. As long as the current site conditions are maintained, the residual concentrations of fuel constituents do not pose a threat to human health or the environment and the unauthorized release case may be closed. If current site conditions change, MCB Camp Pendleton is obligated to inform the Regional Board of those changes. The case files are available for public review by submitting a file review request to the Regional Board office. L. Proposed UST Closure - Site 1324, MCB Camp Pendleton
The Site Mitigation & Cleanup Unit has reviewed the "Final Site Assessment Report, UST Site 1324, Marine Corps Base Camp Pendleton, San Diego County, California" prepared by General Dynamics dated October 31, 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. Site assessment was conducted in June 2006, and the results indicate that the majority of soil contamination is limited to approximately 28 cubic yards at depths of approximately 11 to 15.5 feet below ground surface (bgs), with the maximum TPH-D concentration of 9,800 mg/kg and the maximum naphthalene concentration of 5.5 mg/kg detected at 15.5 feet bgs. No evidence of ground-water contamination was observed. As long as the current site conditions are maintained, the residual concentrations of fuel constituents do not pose a threat to human health or the environment and the unauthorized release case may be closed. If current site conditions change, MCB Camp Pendleton is obligated to inform the Regional Board of those changes. The case files are available for public review by submitting a file review request to the Regional Board office. The Site Mitigation & Cleanup Unit has reviewed the "Final Site Assessment Report, UST Site 1364, Marine Corps Base Camp Pendleton, San Diego County, California" prepared by General Dynamics and dated October 27, 2006. In the report, the consultant recommends no further action at the site of petroleum hydrocarbon contaminated soil as a result of an unauthorized release from the former UST. Site assessment was conducted in June 2006, and the results indicate that the majority of soil contamination is limited to approximately 75 cubic yards at depths of approximately 2.0 to 8.5 feet below ground surface (bgs), with the maximum TPH-D concentration of 5,400 mg/kg and the maximum naphthalene concentration of 1.9 mg/kg detected at 8.5 feet bgs. No evidence of ground-water contamination was observed. As long as the current site conditions are maintained, the residual concentrations of fuel constituents do not pose a threat to human health or the environment and the unauthorized release case may be closed. If current site conditions change, MCB Camp Pendleton is obligated to inform the Regional Board of those changes. The case files are available for public review by submitting a file review request to the Regional Board office. The San Diego Regional Water Quality Control Board (Regional Board) reviewed the letter Work Plan for Groundwater Monitoring, UST Site 12 (Former Building 1281), Marine Corps Base Camp Pendleton, California prepared by Navy Public Works Center San Diego dated May 2006. Regional Board staff recommends the implementation of the work plan. This public notice fulfills the Regional Board's public participation obligation outlined in the California Code of Regulations, Title 23, Division 3, Chapter 16, Article 11, Section 2728. Provided no significant issues arise during the public notification process, the Regional Board will notify the Base of our acceptance of the Navy Public Works Center's recommendation for future environmental activities at the site. O. 45-day notice: Pursuant to California Code of Regulations, Title 27 §21730(b), the California Regional Water Quality Control Board, San Diego Region is providing the following notice to consider adoption of tentative Addendum No. 5 to Order No. 97-11 "General Waste Discharge Requirements for Post-Closure Maintenance of Inactive Nonhazardous and Hazardous Waste Landfills within the San Diego Region." The Regional Board plans to schedule an agenda item, to receive public comments and consider adoption of tentative Addendum No. 5, during its regularly scheduled meeting on February 14, 2007. Tentative Addendum No. 5 to Order 97-11 would terminate the enrollment of the Survival, Evasion, Resistance, and Escape (SERE) Camp Landfill. (Amy Grove)
