San Diego Region - Pending Active Administrative Civil Liability (ACL) Complaints

Administrative Civil Liability Complaint No. R9-2024-0090 (5/23/2024)

The California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) Prosecution Team issued an Administrative Civil Liability Complaint (Complaint) on May 23, 2024, to Olivia Yutang Liu. The Complaint alleges two violations for failure to comply with Cleanup and Abatement and Water Code Section 13267 Order No. R9-2021-0165 (Cleanup Order), which has delayed the cleanup and abatement of waste as required by the Cleanup Order, including unauthorized discharges of cannabis cultivation related waste to an unnamed ephemeral stream and alteration and diversion of the unnamed ephemeral stream that crosses through the site and is tributary to Buena Vista Creek, in Ranchita, CA, and proposes payment of $409,534 in liability, calculated in accordance with the State Water Board’s Enforcement Policy.

Administrative Civil Liability Complaint No. R9-2023-0015 (7/1/2024)

The California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) Prosecution Team issued an Administrative Civil Liability Complaint (Complaint) on April 4, 2023, to the City of Oceanside.  The Complaint alleges two unauthorized high volume sanitary sewage overflows in April 2020 to Buena Vista Creek, Buena Vista Lagoon, Pilgrim Creek and Windmill Creek, in Oceanside, CA, and proposes payment of $1,807,321 in liability, calculated in accordance with the State Water Board’s Enforcement Policy.

On April 7, 2023, the City of Oceanside waived its right to a hearing within 90 days in order to engage in settlement discussions discussions with the Prosecution Team.  As described in Tentative Order No. R9-2024-0060, to resolve these violations without formal administrative proceedings, the parties have agreed to the imposition of an administrative civil liability in the amount of $1,537,737. The Tentative Order is currently subject to a 30-day public review and written comment period, prior to San Diego Water Board consideration for approval.  The Tentative Order, and instructions for how to provide written comments, can be accessed on the San Diego Water Board's Tentative Orders Webpage
