Bradley Park/Old Linda Vista Landfill, San Marcos
On May 30, 2008 the Regional Board issued Notice of Violation No. R9-2008-0051 [NOV R9-2008-0051] for failure to submit the required technical information, and a comment letter [RWQCB Comments on ROWD] outlining the deficiencies of the Report of Waste Discharge.
On January 30, 2008 the Regional Board received a Report of Waste Discharge from the City of San Marcos in response to requirements outlined in Investigative Orders No. R9-2006-0044 and R9-2007-0041.
On September 21, 2007 the Regional Board issued Notice of Violation R9-2007-0196 to the City of San Marcos for the failure to submit a complete Report of Waste Discharge by May 18, 2007, as required by Investigative Order R9-2006-0044.
On May 18, 2007 the Regional Board received an Evaluation Monitoring Report from the City of San Marcos in response to Investigative Order No. R9-2006-0044.
On February 7, 2007 the Regional Board issued a comment letter to the City of San Marcos outlining the deficiencies of the Evaluation Monitoring Program Workplan for the Bradley Park Landfill.
On November 3, 2006, the Regional Board received a proposed revised work plan from the City of San Marcos in response to Order R9-2006-0044. On February 7, 2007, the Regional Board issued a letter containing the results of our review of the work plan [RWQCB Response Feb 2007].
On July 17, 2006, the Regional Board received a proposed work plan from the City of San Marcos in response to Order R9-2006-0044. On August 21, 2006, the Regional Board issued a letter containing the results of our review of the work plan [ RWQCB Response ].
On April 17, 2006 the Regional Board issued Investigative [ Order R9-2006-0044 ] to the City of San Marcos in response to releases of waste constituents from the Bradley Park/Old Linda Vista Landfill. On September 28, 2006, the Regional Board amended the Order granting the Discharger an extension of a due date [Addendum 1][Addendum 2].
Appeal of Order R9-2006-0044
On May 16, 2006 the City of San Marcos (City) filed an appeal of Water Quality Investigative Order R9-2006-0044 with the California Regional Water Quality Control Board, San Diego Region (Regional Board). The original appeal was held in abeyance while the City and County of San Diego (County) attempted to resolve the matter. The City reactivated their original appeal by letter dated August 28, 2006.
In October 2006, the City and County (parties) agreed to provide the Regional Board with legal briefs, and other supporting documentation, on their respective positions regarding the appeal. Below are the legal briefs provided to the Regional Board by the City and County on this matter:
