Shipyard Sediment Site CEQA (08/03/2011)

Proceedings are underway at the California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) to consider development and issuance of a cleanup and abatement order for discharges of metals and other pollutant wastes to San Diego Bay marine sediment and waters located within and adjacent to BAE Systems San Diego Ship Repair (formerly called Southwest Marine Inc.) and National Steel and Shipbuilding Company leaseholds. This area is collectively referred to as the "Shipyard Sediment Site". The Shipyard Sediment Site is located in San Diego Bay generally between Sampson Street extension and the mouth of Chollas Creek in the City of San Diego.

The San Diego Water Board staff members participating in the proceedings are separated into two groups to help assure the fairness and impartiality of the San Diego Water Board's proceedings:

Shipyard Sediment Site Cleanup Team: The Shipyard Sediment Site Cleanup Team (Cleanup Team), has responsibility for development of a tentative cleanup and abatement order and a supporting Technical Report, evaluating testimony and written submittals from Parties and other interested persons, and presenting evidence and recommendations to the San Diego Water Board on sediment cleanup issues that will be described in a public hearing notice. Shipyard Sediment Site Advisory Team: The Shipyard Sediment Site Advisory Team (Advisory Team), assists the San Diego Water Board Chair in matters such as issuance of pre-hearing conference and pubic hearing notices, evaluating requests for designated party status, enforcing deadlines and other limitations on written and electronic submissions and exhibits, and preparing for and conducting the proceedings. The Advisory Team may also provide advice to the San Diego Water Board Chair and other San Diego Water Board members in their deliberations on the evidence presented in the proceedings. Cleanup and Abatement Order and Technical Report
On September 15, 2010 the San Diego Water Board released for public information, the most recent version of the tentative cleanup and abatement order (CAO) (see tentative CAO No. R9-2011-0001 and supporting Draft Technical Report (DTR)). A public hearing schedule and deadline for public comments on the tentative CAO and draft DTR will be established in a future ruling by the San Diego Water Board's Presiding Officer in this matter.

Under the terms of the tentative CAO over 140,000 cubic yards of contaminated sediments will be removed from approximately 15.2 acres of the Shipyard Sediment Site with dredge buckets. In addition to the 15.2 acres targeted for dredging, approximately 2.3 acres of the project site are inaccessible or under-pier areas that would be remediated by one or more methods other than dredging, most likely by sand cover. Sand capping would involve the transport of capping material to the site (possibly via truck or barge) and placement of the materials over contaminated sediment. The California Environmental Quality Act (CEQA) requires that the environmental effects of these types of physical disturbances to the environment be reviewed and evaluated in an Environmental Impact Report (EIR), to identify alternatives, and to disclose possible ways to reduce or avoid the possible environmental damage before the cleanup can begin.

The EIR for the proposed cleanup project will include the analysis of the environmental impacts of sediment management, including the impacts of the proposed dredging activities, handling of the dredged material, dewatering and potential treatment of the dredged material, and transport to the disposal site. These effects may include but not be limited to the potential for release of contaminants into the water and air as a result of the sediment management activities, air quality impacts from the equipment emissions and vehicular trips associated with the dredge activity, and short-term noise from truck trips traveling to and from the project site/shore to the freeway. Once funding is received and a qualified CEQA consultant is retained, the San Diego Water Board is projecting that an administrative draft environmental impact report could be released for public review within 22 weeks of the Board's authorization to the consultant to proceed with the development of an EIR. The Board is also projecting that an EIR could be ready for certification within 11 months of this date.
