Administrative Civil Liability – Belfast Ranch

On November 16, 2007, the Regional Board's Assistant Executive Officer issued Administrative Civil Liability Complaint No. R6T-2007-0007 recommending a $100,000 assessment of civil liability to to Everd A. McCain, B. J. Deis, and McCain and Associates for violations of the Clean Water Act, California Water Code, and Waste Discharge Prohibitions specified by the Water Quality Control Plan for the Lahontan Region, Skeet Dam and Buzz Dam, Belfast Ranch, Lassen County.

The Water Board prosecution team and Mr. McCain have reached a settlement of the alleged violations. The settlement and proposed Administrative Civil Liability Order that would effectuate the settlement will be considered at the Water Board’s January 14-15, 2009 meeting in Truckee. The Complaint, Settlement Agreement, proposed Administrative Civil Liability Order and Notice are below. Comments on the proposed settlement are due by 5:00 p.m. on December 29, 2008.
