TECHNICAL CONSIDERATIONS

  • Data Definitions:
    • Direct Costs: These are program staff salaries and contract costs attributed to each WDPF fee program.
    • Indirect/Overhead: Indirect costs are associated with staff salaries that support WDPF programs in the areas of administration, technology, legal services, executive management, and pro rata. Overhead costs are associated with general operating expenses, such as rent, utilities, and equipment.
      • Pro Rata: Costs billed to the State Water Board by the State’s Control agencies (i.e., Department of Finance, State Controller’s Office, State Treasurer’s Office, etc.) for services provided.     • Foundational Programs: These are programs that benefit all WDPF dischargers or the State Water Board’s water Quality goals in general. Each WDPF program pays a proportional percentage based on their portion of the overall WDPF budget. Currently, these programs are; Total Maximum Daily Load (TMDL), Basin Planning, Ambient Water Monitoring (except Ag Lands), and Enforcement.
    • Other: Other costs include Local Assistance for Beach Monitoring and other state operation cost appropriations for Cal EPA and FI$CAL.

Authority to set fees
Water Code Section 13260 requires each person who dischargers waste or proposes to discharge waste that could affect the quality of the waters of the state to file a report of waste discharge with the appropriate regional water board and to pay an annual fee set by the State Water Board, the funds from which are to be deposited in the Waste Discharge Permit Fund (WDPF). Water Code section 13260 requires the State Water Board to adopt, by emergency regulations, an annual schedule of fees for persons discharging waste to the waters of the state. Water Code section 13260 further requires the State Water Board to adjust the fees annually to conform to the revenue levels set forth in the Budget Act.
