WHEREAS:
- The United States Environmental Protection Agency (USEPA) has promulgated nationwide standards for location, design, operation, monitoring, closure, and post-closure maintenance at municipal solid waste landfills (MSW landfills) pursuant to Subtitle D of the Resource Conservation and Recover Act (42 USC 6901, et seq., at 6940, et seq.), most of which were scheduled to take effect on October 9, 1993;
- The Board adopted Resolution No. 93-62, entitled "Policy For Regulation Of Discharges Of Municipal Solid Waste", requiring Regional Water Quality Control Boards to revise the Waste Discharge Requirements of all dischargers owning or operating MSW landfills that had received solid waste after October 9, 1991, by the "Federal Deadline" to bring such Waste Discharge Requirements into full compliance both with the State Water Board's regulations governing discharges of waste (Chapter 15 of Division 3 of Title 23 of the California Code of Regulations, 23 CCR 2510 et seq., "Chapter 15") and with the "federal MSW regulations" (40 CFR Part 258); and
- The USEPA has extended the Federal Deadlines for compliance with certain portions of the federal program (e.g., containment systems, monitoring, and financial assurance) for certain categories of dischargers (e.g., where the subject MSW landfill receives less than 100 tons per day), while maintaining the previous Federal Deadline schedule for certain other discharger categories (e.g., where the subject MSW landfill is a Superfund Site).
THEREFORE BE IT RESOLVED THAT:

Deadlines.
Except as provided in Section II of this resolution, it is the intent of the Board that any reference to the term "Federal Deadline" either in State Water Board Resolution No. 93-62 or in Waste Discharge Requirements (or in other Regional Water Board orders) implementing that Resolution shall be interpreted in accordance with applicable compliance dates established in the revision of the federal MSW regulations promulgated on October 1, 1993 (58 FR 51536). -

It is the intent of the Board that this interpretation of State Water Board Resolution No. 93-62 shall not preclude any Regional Water Quality Control Board from requiring an owner or operator of an MSW landfill to achieve compliance either with earlier deadlines in Chapter 15 or with other earlier deadlines established by the Regional Water Board
