Annual Registration Program Information 2021

Introduction

Water Code section 1228.2, subdivision (c) provides that the State Water Resources Control Board (State Water Board), Division of Water Rights (Division) shall post the following information on this website:

  1. a summary of the location, nature, and amount of water appropriated pursuant to the water rights registration program; and,
  2. a description of the availability of unappropriated water in those stream systems which may become fully appropriated within the next reporting period.

Availability of Unappropriated Water

This section provides a description of the availability of unappropriated water in those stream systems which may become fully appropriated between July 1, 2019 and June 30, 2020.

County Stream System Description
Nevada, Placer, Sierra Lake Tahoe and Truckee River Basin Water Rights Decision 1651 provides that the State Water Board should administer water rights with a view towards assuring that water use is consistent with the Interstate Settlement Act (Act). Under provisions of the Act, the Truckee River Operating Agreement has taken effect. Due to the uncertainty regarding the amount of water that will be made available for California water rights, applications in the stream system will be required to perform a water availability analysis to show that water is available for that project.

If a registration is filed with a source of supply on a stream system listed above, the registration will not take effect unless the Division finds that unappropriated water is available for the appropriation proposed in the registration. If the Division finds that unappropriated water is not available to supply the appropriation proposed in the registration, the stream system will be considered for inclusion on the State Water Board’s Declaration of Fully Appropriated Stream Systems.

Water Code section 1205 et seq. provides that the State Water Board, following notice and hearing and upon making specified findings, may adopt, revise, or revoke a declaration that a stream system is fully appropriated. Upon inclusion of a stream system on such a declaration, the State Water Board thereafter is prohibited from accepting for filing any application to appropriate water by permit or registration with a source of supply on the stream system, except that the declaration may specify conditions and limitations under which the State Water Board will accept the filing of applications and registrations.
