Justin Baldwin and Mia Baldwin as Trustees of the Baldwin J and M Trust, Humboldt Spirit Inc., and Sprowl Creek LLC (the Dischargers).
Proposed Order No. R1-2026-0050 is a conditional settlement offer to the Dischargers for their failure to comply with the deadlines in Cleanup and Abatement and Investigative Order No. R1-2023-0042. The Proposed Order extends the deadline to fully implement an approved Cleanup Restoration and Monitoring Plan (CRMP) by October 15, 2028 and to submit a CRMP Completion Report by December 14, 2028. The Proposed Order prescribes administrative civil liability of $5,830 per day of violation up to the maximum liability of $116,592 for failure to implement the CRMP and $349 per day of violation up to the maximum liability of $6,980 for failure to submit the CRMP Completion Report by the deadline.
