The State Water Board Evaluation staff uses the CERS UST CME Data Download to analyze the CUPA’s RTC data. The evaluation staff specifically reviews construction, monitoring and testing violations with an RTC of more than 60 days and those without an RTC. The State Water Board does not believe that RTC alone is particularly meaningful in determining a CUPA’s capability of obtaining facility compliance.
The following compliance components will be assessed in conjunction with RTC:
- The number of UST facilities with the CUPA’s jurisdiction
- Number of violations issued during the evaluation period
- Type of violations issued (e.g., violations that require construction work and take a significant amount of time)
- TCR data
- Enforcement Data
- Repeat violations reissued
- RTC trend during the timeframe evaluated
- Scheduled RTC vs Actual RTC
- Using "Not Resolvable" qualifier
