General Information
- On August 28, 2008, the Orange County Superior Court, in a written ruling, directed that Writ of Mandate shall be modified to eliminate an injunction requiring the State Water Resources Control Board (State Water Board) to "cease, desist and suspend all activities relating to the implementation, application, and/or enforcement of the Standards in the [Los Angeles Regional Water Quality Control Board's] Basin Plan, as applied or to be applied to Stormwater." This injunction had prohibited the State Water Board from conducting a number of storm water regulatory activities, including the processing of certain water quality petitions and the adoption or enforcement of certain NPDES storm water permit provisions. With the new court order, full implementation of the State Water Board’s pre-existing storm water regulatory program has resumed.
- On August 1, 2008, the Orange County Superior Court issued an order limiting the effect of a Writ of Mandate, and allowing the processing of Notices of Intent (NOIs) and Notices of Terminations (NOTs). The Writ of Mandate had ordered the State Water Resources Control Board to "cease, desist and suspend all activities relating to the implementation, application, and/or enforcement of the Standards in the [Los Angeles Regional Water Quality Control Board's] Basin Plan, as applied or to be applied to Stormwater." This injunction had prohibited the approval of NOIs and NOTs in the Los Angeles Region under the Statewide National Pollutant Discharge Elimination System Construction, Small Linear Utility, and Industrial Storm Water General Permits. With the new court order, processing of these documents has resumed.
- On July 2, 2008, the Orange County Superior Court issued a Writ of Mandate ordering the State Water Resources Control Board (State Water Board) to “cease, desist and suspend all activities relating to the implementation, application, and/or enforcement of the Standards in the [Los Angeles Regional Water Quality Control Board’s] Basin Plan, as applied or to be applied to Stormwater.” This injunction prohibits the approval of Notices of Intent (NOIs) and Notice of Terminations (NOTs) in the Los Angeles Region under the Statewide National Pollutant Discharge Elimination System Construction, Small Linear Utility, and Industrial Storm Water General Permits.
